SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately represent our products and services. However, colors and product appearance may vary from what appears on your screen due to differences in devices, displays, settings and other factors.

We do not guarantee that the appearance or quality of products will be identical to how they appear digitally.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue products or limit quantities offered to any person, geographic region or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. LiliLaVal reserves the right to accept or decline an order in accordance with applicable law. Your order is not accepted until LiliLaVal confirms acceptance and payment has been successfully processed.

Please review your order carefully before submitting it. Because many LiliLaVal products are custom-made, cancellation or modification requests may not be accommodated once production has begun.

If we need to change, decline or cancel an order, we will make reasonable efforts to contact you using the email address, billing information or phone number provided with your order.

Purchases are subject to our Return & Refund Policy.

Products purchased from LiliLaVal may be used for personal or commercial purposes, provided that your use complies with applicable law and these Terms.

SECTION 4 - CUSTOM PRODUCTS AND CUSTOMER-PROVIDED ARTWORK

Certain LiliLaVal products, including custom DTF transfers, are produced according to artwork, dimensions, quantities and other specifications provided or selected by the customer.

You are responsible for reviewing and confirming all artwork, dimensions, quantities, spelling and other order details before submitting your order.

LiliLaVal is not responsible for errors contained in customer-provided artwork or for reduced print quality resulting from low-resolution, blurry, pixelated, improperly sized or otherwise unsuitable files.

Colors displayed digitally may vary from the final printed product due to differences in screens, color profiles, printing processes and materials.

By uploading or otherwise submitting artwork to LiliLaVal, you represent and warrant that you own the artwork or possess all necessary rights, licenses and permissions to reproduce it. You authorize LiliLaVal to reproduce the submitted artwork as reasonably necessary to manufacture and fulfill your order.

You agree not to submit artwork that infringes or violates another person's copyright, trademark, privacy, publicity or other legal rights.

We reserve the right to decline or cancel an order containing artwork that we reasonably believe may violate applicable law or the intellectual property or other rights of a third party.

Custom products may be subject to additional cancellation, return and refund restrictions as described in our Return & Refund Policy.

SECTION 5 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect when the order is placed and will appear in your order confirmation.

Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, customs or import charges.

We may occasionally offer promotions that are subject to separate terms and conditions. If the terms of a promotion conflict with these Terms, the promotion-specific terms will govern with respect to that promotion.

You agree to provide current, complete and accurate purchase, payment and account information.

You represent that payment information submitted by you is accurate and that you are authorized to use the applicable payment method. You agree to pay all authorized charges associated with your order, including applicable shipping charges and taxes.

SECTION 6 - SHIPPING AND DELIVERY

Processing time and shipping transit time are separate.

Because certain LiliLaVal products are made to order, products may require production time before they are transferred to the shipping carrier.

Delivery dates and transit times displayed on our website or during checkout are estimates unless expressly stated otherwise.

Carrier delays, weather, holidays, incorrect addresses and other circumstances outside of our reasonable control may affect delivery.

SECTION 7 - DTF TRANSFER APPLICATION

Customers are responsible for properly applying DTF transfers and following any pressing or application instructions provided by LiliLaVal.

Results may vary depending on the garment, heat press, temperature, pressure, pressing time, peeling method and other application conditions.

LiliLaVal is not responsible for transfers or garments damaged as a result of incorrect application, incorrect temperature or pressure, incompatible materials, improper equipment, failure to follow provided instructions, or other application errors occurring after delivery.

If you are unsure about application instructions, please contact us before applying your transfer.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including our branding, text, displays, images, graphics, videos, audio, website design and other original content, are owned by LiliLaVal, its licensors or applicable third parties and may be protected by intellectual property laws.

Except as expressly permitted by these Terms, you may not reproduce, distribute, modify, republish, display, transmit or commercially exploit materials owned by LiliLaVal without prior written permission.

Nothing in these Terms grants you ownership of LiliLaVal's trademarks, branding or other intellectual property.

Customer-provided artwork remains subject to the ownership rights of the customer or applicable rights holder. Submission of artwork to LiliLaVal grants us only the rights reasonably necessary to process and fulfill the applicable order, unless otherwise agreed.

Shopify's names, logos, product names, service names and other marks remain the property of Shopify or its applicable licensors.

SECTION 9 - OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services that we do not monitor or control.

Such tools may be provided "as is" and "as available" without warranties, representations or conditions from LiliLaVal. Your use of optional third-party tools is at your own risk and discretion and may be subject to additional third-party terms.

We may offer new features, tools or resources through the Services in the future. Such features will also be subject to these Terms where applicable.

SECTION 10 - THIRD-PARTY LINKS

The Services may contain materials or links to websites operated by third parties.

LiliLaVal is not responsible for examining or evaluating the content, accuracy, practices, products or services of third-party websites.

If you access third-party websites, you do so subject to their applicable terms and policies. Questions or concerns regarding third-party products or services should generally be directed to the applicable third party.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

LiliLaVal is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LiliLaVal.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and LiliLaVal, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with LiliLaVal to the extent permitted by applicable law.

SECTION 12 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide and improve its services.

Information submitted through the Services may also be transmitted to service providers and other third parties as described in our Privacy Policy.

Please review our Privacy Policy for additional information regarding the collection, use and disclosure of personal information.

SECTION 13 - FEEDBACK

If you submit reviews, suggestions, ideas, feedback or other similar content ("Feedback"), you grant LiliLaVal a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute that Feedback for purposes including operating, improving and promoting our business and Services, subject to applicable law.

You represent that you own or have the necessary rights to the Feedback you submit and that your Feedback does not violate the rights of another person.

You may not submit unlawful, abusive, obscene, defamatory, misleading or malicious content or content containing malware.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information available through the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability or other information.

We reserve the right to correct errors, inaccuracies or omissions and to update information or cancel affected orders when appropriate and permitted by applicable law.

SECTION 15 - PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to violate applicable laws or regulations; infringe the intellectual property or other rights of another person; transmit malicious code; engage in fraud or deception; harass or harm another person; collect personal information unlawfully; interfere with the security or operation of the Services; or engage in other unlawful or harmful conduct.

You may not use automated systems, scraping tools, bots or similar technology to access or interfere with the Services in a manner prohibited by applicable law or our reasonable technical restrictions.

We reserve the right to restrict or terminate access to the Services when we reasonably determine that these Terms have been violated.

SECTION 16 - AGENTS

This section applies if you use, allow, enable or cause an autonomous or semi-autonomous software agent ("Agent") to access, use or interact with the Services.

Agents must truthfully identify themselves as automated systems where required, comply with applicable technical requirements and restrictions, and must not circumvent CAPTCHAs, access controls or other measures intended to restrict automated access.

We may limit whether and how Agents interact with the Services.

SECTION 17 - TERMINATION

We may suspend or terminate access to the Services in accordance with these Terms and applicable law.

Any provisions that by their nature should survive termination—including provisions concerning intellectual property, liability, indemnification and governing law—will continue to apply after termination.

SECTION 18 - DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," EXCEPT AS EXPRESSLY PROVIDED OTHERWISE.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Nothing in these Terms is intended to exclude or limit rights or warranties that cannot lawfully be excluded or limited.

SECTION 19 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LILILAVAL AND ITS AFFILIATES, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOSS OF DATA OR SIMILAR DAMAGES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 20 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless LiliLaVal, Shopify and their respective affiliates, partners, employees, agents, contractors, licensors and service providers from third-party claims, losses, damages or liabilities arising from your material breach of these Terms, your violation of applicable law, or your violation of another person's rights.

This includes claims arising from customer-provided artwork that you did not have the legal right or permission to reproduce.

SECTION 21 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed as necessary.

The remaining provisions will continue in full force and effect.

SECTION 22 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies referenced herein constitute the agreement between you and LiliLaVal regarding your use of the Services, except where separate written terms expressly apply.

SECTION 23 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may transfer or assign our rights and obligations in connection with a sale, restructuring or transfer of our business or as otherwise permitted by applicable law.

SECTION 24 - GOVERNING LAW

These Terms and any separate agreements through which we provide Services will be governed and construed in accordance with applicable laws of the United States and the State of California, without limiting any mandatory consumer protections that may apply.

Headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 26 - CHANGES TO TERMS OF SERVICE

You may review the current version of these Terms of Service on our website.

We reserve the right to update or modify these Terms from time to time. When required by applicable law, we will provide notice of material changes.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
